01Who we are
gphlab.ai is owned and operated by GPHInnovation, a sole proprietorship firm based in Uttar Pradesh, India, run by its proprietor Karishma Singh Rathore ("we", "us", "our"). Because GPHInnovation is a proprietorship, your agreement under these Terms is with the proprietor trading as GPHInnovation. These Terms of Service ("Terms") apply to our website gphlab.ai, our web app at app.gphlab.ai (the "App") and any services we provide to you.
By creating an account, buying credits or using our website or App, you agree to these Terms. If you do not agree, please do not use them.
02Your account
- You must be at least 18 years old and able to enter a binding contract.
- Give accurate details when you sign up, including a real email address you can access.
- Keep your password private. You are responsible for activity on your account.
- One person per account. Do not create multiple accounts to collect free credits.
- Tell us straight away if you think someone else has accessed your account.
03Credits
- The App runs on prepaid credits. Each action shows its credit cost before you start, for example a deep blueprint, a quick scan or a strategist question.
- Credits are deducted when an action starts. If an AI job fails on our side, the credits are returned to your balance automatically.
- Free welcome credits are a promotional gift. They have no cash value and may be changed or withdrawn for new sign-ups at any time.
- Purchased credits do not expire while your account is active. Credits cannot be transferred, resold or exchanged for cash, except as described in our Refund Policy.
- Prices are shown on the Credits page in Indian Rupees and may change. A price change never affects credits you have already bought.
04AI-generated content
The App uses artificial intelligence, including third-party AI models and live web search, to produce research, niche ideas, offers, pricing suggestions and plans ("Output").
- Output is for information and planning only. It is not financial, legal, tax, medical or professional advice.
- AI can be wrong, incomplete or out of date, and web sources may be inaccurate. Check important facts, figures and sources before you rely on them.
- We do not promise any particular business result, income or revenue from using the Output.
- Similar inputs from different users may produce similar Output. We cannot guarantee that Output is unique to you.
05Ownership
- Your inputs and Output: you keep the rights to the information you enter. Subject to these Terms and your payment, you may use the Output you generate for your own personal and business purposes.
- Our platform: the website, App, software, design, brand, logo and content we create belong to GPHInnovation. You may not copy, resell or rebuild them.
- Client services: ownership of work we deliver under a separate proposal, such as books, websites or chatbots, is set out in that proposal or invoice.
06Acceptable use
You agree not to:
- break any law, or use the App for fraud, spam, harassment or to harm others;
- enter content you do not have the right to share, or other people's personal data without permission;
- try to get around credit limits, rate limits, security checks or private-access rules;
- scrape, overload, reverse-engineer or attack the App, or access it with bots or automated scripts;
- copy or replicate the App's features, workflows, prompts or design to build a competing product;
- use the App to create or publish harmful, deceptive, defamatory or misleading content, or present AI Output as verified fact or professional advice to others;
- resell access to the App or share your login details with anyone else.
We may suspend or close accounts that break these rules. Credits on such accounts are forfeited and are not eligible for a refund.
07Leads and contacts you collect
The Contacts feature lets you collect enquiries from your own website forms, landing pages and other lead sources, and import or add contacts yourself. For this information:
- You own it and you are responsible for it. You decide what you collect and why, and you are the data fiduciary for those people under India's Digital Personal Data Protection Act, 2023 and any other law that applies to you.
- You must have a lawful reason and any required consent to collect and use each person's details, and your own forms should link to your own privacy notice.
- You must not upload or collect sensitive data you do not need, such as passwords, card numbers or health records, or data bought from list sellers.
- We only store and process it on your behalf to provide the App. We never sell it, never contact your leads, and never use it for our own marketing.
- You can export or delete your contacts at any time. If someone asks you to delete their details, you can do so from the Contacts page.
08Done-for-you services
Agency services such as book writing and ghostwriting, AEO funnels, website development, AI chatbots, AI apps and Meta Ads management are delivered under a separate proposal, quote or invoice. That document sets out the scope, timelines, fees, payment terms and deliverables, and it takes priority over these Terms if the two conflict. Advertising platform fees, such as Meta ad spend, are paid by you directly unless agreed otherwise in writing.
09Payments and taxes
Payments are made in full and in advance by UPI, bank transfer, card or another method we offer. Prices may be shown with or without applicable taxes such as GST, and your invoice will show the tax breakdown. Credits are added to your account once your payment is confirmed.
Card and online payments may be processed by a third-party payment gateway such as Razorpay, whose own terms apply. We are not responsible for failures, delays or charges caused by the payment provider or your bank, but we will help you resolve them.
Purchases made under a discount, coupon, festival offer or launch deal are final and non-refundable. We will always say so clearly at the time of sale. See our Refund Policy for full details.
10Connected services
Some features let you connect or use outside services, for example Meta (Facebook and Instagram), WhatsApp Business, Google, website builders or analytics tools. When you connect one:
- information is exchanged with that service only as needed for the feature and within the permissions you give;
- that service's own terms and privacy policy apply to how it handles your data;
- we are not responsible for outages, policy changes, account restrictions or charges made by those services, such as Meta ad spend or WhatsApp message fees.
11Availability and changes
We work to keep the App available and accurate, but it is provided "as is" and "as available". We may update, pause or discontinue features, change credit costs for future actions, and carry out maintenance. If we permanently close the App, we will give reasonable notice and handle unused purchased credits as described in our Refund Policy.
12Limitation of liability
To the fullest extent the law allows:
- we are not liable for indirect or consequential losses, such as loss of profit, revenue, business or data, arising from your use of the website, App or Output;
- our total liability to you for any claim about the App is limited to the amount you paid us for credits in the 3 months before the claim.
Nothing in these Terms limits liability that cannot be limited under applicable Indian law.
13Your data
Your account data, blueprints and contacts are stored on servers located in India. Some features send your inputs to trusted AI and security providers outside India, as explained in our Privacy Policy. When your account is closed, we keep your data for 90 days so you can ask for an export or change your mind, and then delete it, except records we must keep by law.
14Ending your account
You can stop using the App at any time and ask us to close your account through our contact page. We may suspend or end your access if you break these Terms or if required by law. When access ends, you must stop using the App, and the data rules in the section above apply.
15Governing law
These Terms are governed by the laws of India, including the Indian Contract Act, 1872, the Information Technology Act, 2000 and the Consumer Protection Act, 2019.
- Talk to us first. Please contact our grievance officer (below) before starting any formal process. Most concerns are resolved this way.
- Arbitration. If a dispute is not resolved within 30 days, it will be referred to a sole arbitrator appointed by mutual agreement under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration will be Gautam Buddh Nagar (Greater Noida), Uttar Pradesh, the proceedings will be in English, and the award will be final and binding.
- Courts. Subject to the above, the courts at Gautam Buddh Nagar (Greater Noida), Uttar Pradesh, India have exclusive jurisdiction, including for any interim relief.
Nothing in this section takes away any right you have as a consumer to approach a consumer commission under the Consumer Protection Act, 2019.
